
SARATOGA SPRINGS — Edward O’Rourke, the man whose gun was allegedly used by his son in the accidental shooting of 12-year-old Nicholas Naumkin in December, was not in court Thursday, but his lawyer was.
Jeffrey Bagnoli is representing O’Rourke for the misdemeanor charge of endangering the welfare of a child.
Naumkin, a seventh-grader at Maple Avenue Middle School, was shot in the head by his friend
Dec. 22 while the two were playing with a handgun police say belongs to O’Rourke.
Police say Naumkin and his friend unloaded and loaded the gun several times before it went off, killing Naumkin.
The father was subsequently arrested because he allegedly left the handgun and “unsecured loose ammunition” in the residence with the two boys alone.
Thursday, Bagnoli met with Saratoga Springs City Judge Jeffrey Wait and Assistant District Attorney Karen A. Heggen to work out “scheduling conflicts.”
At this point, no court date has been set. Bagnoli has until Aug. 11 to submit any motions he intends to make, which he said he will submit some time within the next two weeks. The DA’s office will have until Sept. 13 to respond.
It remains unclear why two judges in Wilton recused themselves from the O’Rourke case, other than the “personal reasons” they cited in the letter on file.
